Terms & Conditions

These Terms and Conditions ("Terms") govern your access to and use of the TMT ELD electronic logging device, mobile application, web platform, GPS tracking services, and all related services (collectively, the "Services") provided by Dream LLC ("TMT ELD," "we," "us," or "our"). By accessing or using our Services, you agree to be bound by these Terms.

1. Eligibility and Account Registration

To use our Services, you must:

  • Be at least 18 years of age.
  • Be a licensed commercial motor vehicle (CMV) operator or authorized representative of a motor carrier.
  • Provide accurate, current, and complete registration information.
  • Maintain the security of your account credentials.

You are responsible for all activity under your account. Notify us immediately at support@dreameld.com if you suspect unauthorized access.

2. Description of Services

TMT ELD provides the following Services:

  • Electronic Logging Device (ELD): FMCSA-registered ELD hardware and software compliant with 49 CFR Part 395 for recording Hours of Service (HOS).
  • GPS Fleet Tracking: Real-time vehicle location tracking, route history, geofencing, and speed monitoring.
  • IFTA Mileage Reporting: Automated state mileage calculations for International Fuel Tax Agreement compliance.
  • Telegram Bot Integration: Real-time fleet alerts and notifications delivered via Telegram messaging.
  • Driver Safety Monitoring: AI-powered dashcam analytics, driving behavior scoring, and incident detection.
  • Fleet Dashboard: Web-based management portal for fleet operations, compliance monitoring, and reporting.

3. FMCSA Compliance

Our ELD is registered with the Federal Motor Carrier Safety Administration (FMCSA) and complies with the ELD mandate under 49 CFR Part 395. However:

  • You are solely responsible for ensuring your drivers properly use the ELD and maintain accurate HOS records.
  • TMT ELD is not liable for any FMCSA violations resulting from driver misuse, tampering, or failure to follow proper procedures.
  • You must ensure all drivers are trained on proper ELD usage per FMCSA guidelines.
  • ELD data must be retained for a minimum of six (6) months per federal regulations.

4. Subscription and Payment

4.1 Plans and Pricing

Our Services are offered on a monthly or annual subscription basis. Current pricing is available at app.zerioneld.com/#pricing. We reserve the right to modify pricing with 30 days' advance notice.

4.2 Billing

  • Subscriptions are billed in advance on a recurring basis (monthly or annually).
  • All fees are in U.S. dollars and are non-refundable except as stated in our refund policy.
  • Failed payments may result in service suspension after a 7-day grace period.

4.3 Hardware

ELD hardware (PT30 device) purchased or leased through TMT ELD remains subject to our hardware warranty terms. Devices must be returned in working condition upon service cancellation if leased.

5. Acceptable Use

You agree NOT to:

  • Tamper with, modify, or reverse-engineer the ELD hardware or software.
  • Use the Services to falsify HOS records or circumvent FMCSA regulations.
  • Share account credentials with unauthorized individuals.
  • Use the GPS tracking features to stalk, harass, or monitor individuals without proper authorization.
  • Interfere with or disrupt the integrity of our Services or servers.
  • Use the Services for any unlawful purpose.

6. Mobile App Permissions and Driver Consent

6.1 Device Permissions

The TMT ELD mobile application requires access to certain device features to perform its regulatory and fleet-management functions. By installing and using the app, you acknowledge and consent to the following:

  • Location (including background location): The app collects precise GPS location continuously while a driver is signed in and connected to a vehicle — including when the app is running in the background or the screen is off. This is required by the FMCSA ELD mandate (49 CFR Part 395) to record vehicle position with duty-status records, and powers GPS fleet tracking and IFTA mileage reporting. Disabling location prevents the app from functioning as a compliant ELD.
  • Bluetooth: The app pairs with the ELD device (PT30) installed in the vehicle's diagnostic port to read engine data such as odometer, engine hours, and vehicle motion status.
  • Camera and Photos: Used only when you attach photos to driver vehicle inspection reports (DVIRs), capture a signature, or update a profile picture.
  • Microphone: Used only during voice calls between drivers and dispatch initiated within the app. The app does not record ambient audio.
  • Notifications and Full-Screen Alerts: Used to deliver time-sensitive Hours of Service warnings (e.g. required breaks, drive-time limits), dispatch messages, and incoming call alerts. Suppressing these notifications may result in missed compliance warnings.
  • Background Operation and Battery Optimization Exemption: The app runs a persistent foreground service and may request exemption from battery optimization so that duty-status recording, ELD connectivity, and location logging are not interrupted by the operating system while driving.

6.2 Driver Monitoring Consent

  • If you are a motor carrier, you are responsible for informing your drivers that their location, duty status, driving behavior, and vehicle data are recorded and shared with authorized carrier personnel, and for obtaining any driver consent required by applicable law before provisioning driver accounts.
  • If you are a driver, you acknowledge that use of the app is subject to monitoring by your motor carrier as part of your employment or contractor relationship, and that ELD records are disclosed to FMCSA/DOT officials during inspections and audits as required by federal law.
  • Location collection is tied to ELD compliance functions and fleet operations. It is not used for advertising and is not sold to third parties.

7. Data Ownership and License

  • Your Data: You retain ownership of all fleet data, HOS records, and GPS data generated through your use of the Services.
  • License to Us: You grant us a limited license to use your data solely to provide, maintain, and improve the Services.
  • Our IP: TMT ELD retains all rights to the platform, software, algorithms, designs, and documentation. You may not copy, distribute, or create derivative works.

8. Service Availability

We strive to maintain 99.9% uptime for our Services. However, we do not guarantee uninterrupted access. Scheduled maintenance windows will be communicated in advance. We are not liable for outages caused by internet service providers, cellular networks, or force majeure events.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • TMT ELD's total liability shall not exceed the amount you paid for Services in the twelve (12) months preceding the claim.
  • We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption.
  • We are not liable for FMCSA fines, DOT violations, or penalties resulting from improper ELD usage by your drivers.

10. Indemnification

You agree to indemnify and hold harmless Dream LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.

11. Termination

  • By You: You may cancel your subscription at any time through your account dashboard or by contacting support. Cancellation takes effect at the end of the current billing period.
  • By Us: We may suspend or terminate your access for violation of these Terms, non-payment, or at our discretion with 30 days' notice.
  • Effect: Upon termination, your right to use the Services ceases. You may export your data within 30 days of termination.

12. Dispute Resolution

Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the American Arbitration Association (AAA) rules. The arbitration shall take place in the State of Illinois. You waive any right to participate in class action lawsuits.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use of Services after changes constitutes acceptance.
